Competition Period 12:00PM Friday 16/07/2021 to 5:00PM Monday 26/07/2021 (AEST) / 2:00PM on Friday 16/07/2021 to 7:00PM Monday 26/07/2021 (NZST).
Entries received by the Promoter after the end of the Competition Period shall not be eligible to take part in the competition.
Who can enter? Only Australian and New Zealand residents aged 18 years and over.
Who can't enter? Directors, officers, management and employees (and their immediate families) of:
(a) the Promoter; and
(b) the agencies, companies or participating premises associated with this competition.
Where will the competition run? The competition will run in Australia and New Zealand.
Entry instructions To receive an automatic entry, you must, during the Competition Period:
(a) Share a post on your personal Instagram profile showing yourself and your dog and tag @kathmandugear and hashtags #OutThere #KathmanduGear;
(b) ‘Like’ the Promotion feed post on the Promoter’s Instagram page https://www.instagram.com/kathmandugear/
You must ensure your social profiles is not private to ensure the judges can access your entry.
This is a game of skill. Chance plays no part in determining shortlisted entrants or the winners. Each entry and entrant will be individually judged on, amongst other things, creative merit. All judging decisions are as determined by the Promoter, in their absolute discretion. The Promoter's decision is final and no correspondence will be entered into. All entries must be the independent creation of the entrant and must not have been copied or published previously in any format. You must not include any other person in your photograph/video unless they have consented to you submitting it in this competition. You must not include any person in your photograph/video who is under the age of 18 years unless you have their parent’s or guardian’s consent and, if the person is aged 13 or above, that person's consent.
How many winners will there be and how will they be chosen? There will be a total of 3 Prize packs.
A judging panel appointed by the Promoter will review each valid entry and will judge the entries to determine the winners. The three (3) winners will be selected based on the most ‘Out There’ adventure with your dog at the discretion of the judging panel.
Judging will take place at the Promoter's office, 249 Park Street, South Melbourne, VIC Australia, by no later than 9:00AM Tuesday, 27th July (AEST) / 11:00AM Tuesday 27th July 2021 (NZST). 
What can I win? There are 3 prize packs, each consisting of:
1 x black Kathmandu dog jacket; and
1 x Kathmandu Heli Thermore jacket (colour of your choosing subject to availability),
Total prize pool The total prize pool is approximately AUD $674.00 / NZD $720.00.
How many times can I enter? You can enter multiple times during the Competition Period provided each entry is unique. Each entry must be in accordance with these Terms and Conditions.
How and when will the winners be informed? Winners will be notified:
• in writing by email; and
• by phone, if required,
within two days of determination and will be listed on www.kathmandu.com.au.
Unclaimed prizes Prize claim date: 9am on 16/08/2021 (AEST) / 11am on 16/08/2021 (NZST) on 01/07/2021 AEST / 12pm on 1/07/2021 NZST
If a prize has not been accepted or claimed by the prize claim date above or if, after making all reasonable attempts, the Promoter can't award the prize or contact the winners (or a winner does not contact the Promoter) by the prize claim date above, the relevant entry/ies will be discarded and the Promoter will award the relevant prize/s to the next best entry as determined by the judges. Any new winner/s will be informed:
• in writing by email; and
• by phone, if required,
within two days of determination and will be listed on www.kathmandu.com.au.
Collection and use of your personal information The Promoter collects personal information about entrants in order to conduct the promotion and administer the prize. If the personal information requested is not provided, a person may not be able to participate. The Promoter may also use entrants' personal information to help improve its goods and services. The Promoter may share entrants' personal information with the Promoter’s related companies, agents and contractors. The Promoter and its related companies may contact entrants' with special offers and marketing via any medium including mail, telephone and commercial electronic messages (including email and SMS). Entrants' personal information may be disclosed to recipients in countries such as Australia, New Zealand, the United Kingdom, and the United States. The Promoter’s Privacy Policy (see www.kathmandu.com.au) includes information about:
(a) how a person can seek access to the personal information the Promoter holds and seek the correction of such information; and
(b) how a person can complain about a breach of privacy and how the Promoter will deal with such a complaint.
  1. These Terms and Conditions incorporate and must be read together with the details outlined in the table above. Information about prizes and how to enter forms part of these Terms and Conditions. By entering, you accept these Terms and Conditions.

  2. Entry

  3. Your entry must be received during the Competition Period and will be deemed to be received only when received by the Promoter. The Promoter is not liable for any problems with communications networks. You are responsible for your own costs associated with entering. If you enter using automatically generated entries or multiple phone numbers/email addresses/addresses/aliases, you may be disqualified.

  4. Prizes

  5. Prizes must be taken as and when offered or will be forfeited, and if forfeited, the Promoter will not be liable. Prizes are subject to any additional terms and conditions imposed by the relevant supplier or the Promoter, including validity periods.

  6. General

  7. If you or your entry are deemed by the Promoter to breach these Terms and Conditions, your entry (or at the Promoter's discretion, all of your entries) may be discarded. The Promoter may, at any time, require you to produce documentation to establish to the Promoter's satisfaction the validity of your entries (including documentation establishing your identity, age, place of residence and place of employment). Failure by the Promoter to enforce any of its rights at any stage does not waive those rights.
  8. You must not:
    (a) tamper with the entry process;
    (b) engage in any conduct that may jeopardise the fair and proper conduct of the competition;
    (c) act in a disruptive, annoying, threatening, abusive or harassing manner;
    (d) do anything that may diminish the good name or reputation of the Promoter or any of its related entities or of the agencies or companies associated with this competition;
    (e) breach any law; or
    (f) behave in a way that is otherwise inappropriate.
  9. The Promoter is not liable for entries, prize claims or correspondence that are misplaced, misdirected, delayed, lost, incomplete, illegible or incorrectly submitted.
  10. The Promoter’s decision in connection with all aspects of this competition is final. If any dispute arises between you and the Promoter concerning the conduct of this promotion or claiming a prize, the Promoter will take reasonable steps to consider your point of view, taking into account any facts or evidence you put forward, and to respond to it fairly within a reasonable time. In all other respects, the Promoter’s decision in connection with all aspects of this competition is final.
  11. Prizes cannot be transferred or exchanged nor redeemed for cash. The prize values are correct as at the date of preparing these Terms and Conditions and include any applicable GST. You agree that if a prize is unavailable for any reason the Promoter may provide another item of equal or higher value, subject to any necessary approval by the Australian state/territory gaming authorities.
  12. If this competition cannot run as planned for any reason beyond the Promoter's control, for example due to software, hardware or communications issues, unauthorised intervention, tampering, fraud or technical failure, the Promoter may end, change, suspend or cancel the competition or disqualify affected entries/entrants, subject to any necessary approval by the Australian state/territory gaming authorities.
  13. The Promoter is not responsible for any tax implications arising from the winner winning a prize. The winner should seek independent financial advice. If for any applicable goods and services tax purposes this Promotion results in any supply being made for non-monetary consideration, the winner must follow the relevant Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal applicable goods and services tax inclusive market values.
  14. The Promoter may copy and edit an entrant's entry and may use (or allow others to use) their name and entry (or an edited version of it) and any rights in relation to their entry, to publicise this Competition or for any other purpose. These rights are perpetual, royalty free, world-wide, irrevocable and transferable and entitle the Promoter to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the entrant’s entry and any accompanying materials for such purposes. For example, the Promoter may publish all or any part of an entrant's entry or any amended version of it. The Promoter may also decide not to publish an entry or to cease publication of an entry. By submitting your promotion entry and any accompanying material, you hereby agree to:
    (a) assign to the Promoter all your intellectual property rights that subsist therein with full title guarantee; and
    (b) waive all moral rights, in and to your promotion entry and otherwise arising in connection with your entry to which you may now or at any time in the future be entitled under the relevant legislation in your country from time to time in force anywhere in the world.
  15. Entrants warrant that their entry is original and does not breach any third party rights (for example, intellectual property rights) and that its use by the Promoter or any other person will not breach such rights nor otherwise breach any law (for example, it is not defamatory, in contempt of court or in breach of any privacy law). Entries must not be obscene, offensive, malicious, discriminatory, indecent or (in the Promoter's opinion) otherwise objectionable or inappropriate (for example they must not include language the Promoter deems offensive).

  16. Liability

  17. Nothing in these Terms and Conditions restricts, excludes or modifies any consumer rights under any statute including the Competition and Consumer Act 2010 (Cth) or the Consumer Guarantees Act 1993 (NZ).
  18. Subject to the previous paragraph, the Promoter and the agencies and companies associated with this competition are not liable (including in negligence) for any loss (including indirect, special or consequential loss or loss of profits), expense, damage, personal injury (including allergies, skin conditions or other reactions, as relevant), illness or death suffered in connection with this competition or any prize, except for any liability which under statute cannot be excluded (in which case that liability is limited to the greatest extent allowed by law).
  19. Without limiting the previous paragraph, the Promoter and the agencies and companies associated with this competition are not liable for any loss of, damage to or delay in delivery of prize/s.
  20. This competition is in no way sponsored, endorsed or administered by, or associated with any social media platform, including Facebook, Instagram and Twitter. You provide your information to the Promoter and not to any social media platform. You completely release any relevant social media platforms from any and all liability.
